By making a reservation, the customer (the “Renter”) agrees to the terms and conditions below. Phosphotopia (75 Chemin Napoléon, Mont-Tremblant, Quebec) acts as the lessor.

1. Purpose
This waiver governs the rental and use of the inflatable play structures provided by Phosphotopia. Installation and dismantling are to be performed by the Lessee in accordance with the instructions provided by Phosphotopia. Throughout the rental period, the Renter is responsible for supervising and ensuring the safe use of the equipment.

2. Acknowledgment of Risks
The Renter acknowledges that the use of an inflatable play structure involves inherent risks, including falls, collisions between users, or injuries. He accepts these risks knowingly, both for himself and for the people he authorizes to use the equipment.

3. Tenant’s Obligations
The Tenant agrees to:

• Ensure that a responsible adult supervises children at all times while they are using the toy;
• comply with and enforce the safety rules provided by Phosphotopia (maximum number of users, age restrictions, no shoes allowed, no sharp objects, no food or drinks on the playground, etc.);
• Keep the game connected to a compliant electrical outlet (110V) during continuous operation;
• Immediately stop use and evacuate the playground in the event of strong winds, rain, thunderstorms, or any other conditions deemed dangerous;
• Notify Phosphotopia immediately in the event of an incident, damage, or injury.

4. Weather Conditions
The use of an inflatable play structure is sensitive to weather conditions. In the event of rain or excessive winds, the rental may be canceled—either before or during the event—for safety reasons. The cancellation and refund terms are outlined in our cancellation policy.

5. Disclaimer and Limitation of Liability
Subject to the limitations provided by law, the Renter releases Phosphotopia from any liability for property damage or personal injury resulting from use that does not comply with safety rules, a failure to supervise, or a breach of these terms and conditions.

6. Indemnification
The Renter agrees to indemnify Phosphotopia for any damage to the equipment resulting from improper use, negligence, or failure to comply with safety rules during the rental period.

7. Acceptance
I hereby declare that I am 18 years of age or older, that I have read and understood this liability waiver as well as Phosphotopia’s safety rules, and that I accept all the terms set forth in this waiver.
